1. Introduction

Welcome to Firearms Australia Marketplace. By accessing or using our website, you agree to comply with and be bound by the following terms and conditions. These terms govern your relationship with Firearms Australia regarding your use of the site and the purchase or sale of any goods.

2. Acceptantance or Rejection of an order

Dealing with firearms is no games. Place an order on a firearm/ammunition only when you are ready to receive it.

  • After placing your order, we will do some age verifications. Goods must be signed for on delivery by a person 18 years of age or over.
  • In certain cases we may need to reject your order. This may happen where the requested product is not available, or if there is an error in the price or the product description posted on the site.
  • After placing your order, be sure to make payment your payment immediately and then send us a screenshot/snapshot of the payment transaction page for confirmation. If your payment confirmation is not sent to our email 30 minutes after the time of placing the order, your order will be cancelled.
  • Each accepted order placed for firearms through our website results in a separate binding agreement between you and our team for the supply of the items. For each order accepted by us, we will;
    – Supply the products in that order to you in accordance with these terms and conditions, and provide you with an email confirmation of that order.
  • If we reject an order placed through the Site, then we will endeavor to notify you of that rejection at the time you place the order or within a reasonable time after you submit your order.

3. Eligibility & Legal Compliance

  • Age Requirement: You must be at least 18 years of age to use this website.

  • Licensing: It is the absolute responsibility of the buyer and seller to ensure they hold the appropriate Firearm Licenses and Permits to Acquire (PTA) required by their respective state or territory laws.

  • Prohibited Use: You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction.

4. Firearms Sales & Transfers

  • Brokerage/Dealer Requirement: In accordance with Australian law, all firearms must be transferred through a Licensed Firearms Dealer (LFD). We can help otherwise for a fee.

  • Free Direct Shipping Prohibited: Firearms will never be shipped directly to an individual’s residence for free. 

  • Verification: We reserve the right to request proof of licensing before processing any order or listing. Not mandatory.

5. Listings and Accuracy

  • We strive for accuracy; however, we do not warrant that product descriptions, photos, or other content are accurate, complete, or error-free.

  • Prices and availability are subject to change without notice.

6. Payments and Refunds

  • Payments: All payments must be made in AUD via our approved payment gateways.

  • Refund Policy: Refunds are subject to the Australian Consumer Law. However, change-of-mind returns may be restricted for firearms and ammunition due to high administrative and re-registration costs.

  • Cancelled PTA: If a purchase is made but the police reject your Permit to Acquire, a restocking fee may apply.

7. Limitation of Liability

Firearms Australia Marketplace shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Firearms Australia has been advised of the possibility of such damages.

8. User Conduct

Users are prohibited from:

  • Posting fraudulent or misleading listings.

  • Attempting to bypass legal transfer requirements.

  • Using the site to harass, abuse, or harm others.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Australia and the specific state in which Firearms Australia is registered (QLD).

10. Changes to Terms

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Your continued use of the website following any changes constitutes your agreement to follow and be bound by the terms as changed.
